Lei nº 13.432/17 regulamenta a profissão de detetive particular

LEI Nº 13.432, DE 11 DE ABRIL DE 2017.

Mensagem de veto

Dispõe sobre o exercício da profissão de detetive particular.

O PRESIDENTE DA REPÚBLICA Faço saber que o Congresso Nacional decreta e eu sanciono a seguinte Lei:

Art. 1o (VETADO).

Art. 2º Para os fins desta Lei, considera-se detetive particular o profissional que, habitualmente, por conta própria ou na forma de sociedade civil ou empresarial, planeje e execute coleta de dados e informações de natureza não criminal, com conhecimento técnico e utilizando recursos e meios tecnológicos permitidos, visando ao esclarecimento de assuntos de interesse privado do contratante.

§ 1º Consideram-se sinônimas, para efeito desta Lei, as expressões "detetive particular", "detetive profissional" e outras que tenham ou venham a ter o mesmo objeto.

Art. 5º O detetive particular pode colaborar com investigação policial em curso, desde que expressamente autorizado pelo contratante.

Parágrafo único. O aceite da colaboração ficará a critério do delegado de polícia, que poderá admiti-la ou rejeitá-la a qualquer tempo.

Art. 6º Em razão da natureza reservada de suas atividades, o detetive particular, no desempenho da profissão, deve agir com técnica, legalidade, honestidade, discrição, zelo e apreço pela verdade.

Art. 7º O detetive particular é obrigado a registrar em instrumento escrito a prestação de seus serviços.

Art. 8º O contrato de prestação de serviços do detetive particular conterá:

I - qualificação completa das partes contratantes;

II - prazo de vigência;

III - natureza do serviço;

IV - relação de documentos e dados fornecidos pelo contratante;

V - local em que será prestado o serviço;

VI - estipulação dos honorários e sua forma de pagamento.

Parágrafo único. É facultada às partes a estipulação de seguro de vida em favor do detetive particular, que indicará os beneficiários, quando a atividade envolver risco de morte.

Art. 9º Ao final do prazo pactuado para a execução dos serviços profissionais, o detetive particular entregará ao contratante ou a seu representante legal, mediante recibo, relatório circunstanciado sobre os dados e informações coletados, que conterá:

I - os procedimentos técnicos adotados;

II - a conclusão em face do resultado dos trabalhos executados e, se for o caso, a indicação das providências legais a adotar;

III - data, identificação completa do detetive particular e sua assinatura.

Art. 10. É vedado ao detetive particular:

I - aceitar ou captar serviço que configure ou contribua para a prática de infração penal ou tenha caráter discriminatório;

II - aceitar contrato de quem já tenha detetive particular constituído, salvo:

a) com autorização prévia daquele com o qual irá colaborar ou a quem substituirá;

b) na hipótese de dissídio entre o contratante e o profissional precedente ou de omissão deste que possa causar dano ao contratante;

III - divulgar os meios e os resultados da coleta de dados e informações a que tiver acesso no exercício da profissão, salvo em defesa própria;

IV - participar diretamente de diligências policiais;

V - utilizar, em demanda contra o contratante, os dados, documentos e informações coletados na execução do contrato.

Art. 11. São deveres do detetive particular:

I - preservar o sigilo das fontes de informação;

II - respeitar o direito à intimidade, à privacidade, à honra e à imagem das pessoas;

III - exercer a profissão com zelo e probidade;

IV - defender, com isenção, os direitos e as prerrogativas profissionais, zelando pela própria reputação e a da classe;

V - zelar pela conservação e proteção de documentos, objetos, dados ou informações que lhe forem confiados pelo cliente;

VI - restituir, íntegro, ao cliente, findo o contrato ou a pedido, documento ou objeto que lhe tenha sido confiado;

VII - prestar contas ao cliente.

Art. 12. São direitos do detetive particular:

I - exercer a profissão em todo o território nacional na defesa dos direitos ou interesses que lhe forem confiados, na forma desta Lei;

II - recusar serviço que considere imoral, discriminatório ou ilícito;

III - renunciar ao serviço contratado, caso gere risco à sua integridade física ou moral;

IV - compensar o montante dos honorários recebidos ou recebê-lo proporcionalmente, de acordo com o período trabalhado, conforme pactuado;

V - (VETADO);

VI - reclamar, verbalmente ou por escrito, perante qualquer autoridade, contra a inobservância de preceito de lei, regulamento ou regimento;

VII - ser publicamente desagravado, quando injustamente ofendido no exercício da profissão.

Art. 13. Esta Lei entra em vigor na data de sua publicação.

Law nº 13.432 / 17 regulates the profession of private detective

LAW No. 13.432, OF APRIL 11, 2017.

Veto message

It deals with the practice of the private detective profession.

THE PRESIDENT OF THE REPUBLIC I hereby announce that the National Congress decrees and I sanction the following Law:

Art. 1 (VETOED).

Art. 2 For the purposes of this Law, a private detective is a professional who, usually, for his own account or in the form of a civil or corporate society, plans and executes the collection of data and information of a non-criminal nature, with technical knowledge and using resources and technological means allowed, in order to clarify matters of private interest of the contractor.

Paragraph 1. The expressions "private detective", "professional detective" and others that have or will have the same object are considered synonymous for the purpose of this Law.

§ 2º (VETOED).

Art. 4 (VETOED).

Art. 5 The private detective may collaborate with ongoing police investigation, provided that it is expressly authorized by the contractor.

Single paragraph. The acceptance of the collaboration will be at the discretion of the police officer, who may admit or reject it at any time.

Art. 6 ° Due to the reserved nature of his activities, the private detective, in the performance of the profession, must act with technique, legality, honesty, discretion, zeal and appreciation for the truth.

Art. 7 The private detective is obliged to register in written instrument the provision of his services.

Art. 8 The contract of provision of services of the private detective will contain:

I - complete qualification of the contracting parties;

II - term of validity;

III - nature of the service;

IV - list of documents and data provided by the contractor;

V - place where the service will be provided;

VI - stipulation of fees and their form of payment.

Single paragraph. The parties are provided with the provision of life insurance in favor of the private detective, who will indicate the beneficiaries, when the activity involves the risk of death.

Art. 9 At the end of the term agreed for the execution of the professional services, the private detective will deliver to the contractor or his legal representative, upon receipt, a detailed report on the data and information collected, which will contain:

I - the technical procedures adopted;

II - the conclusion in the face of the result of the works executed and, if it is the case, the indication of the legal measures to be adopted;

III - date, complete identification of the private detective and his / her signature.

Art. 10. It is forbidden to the private detective:

I - accept or capture service that configures or contributes to the practice of criminal infraction or has a discriminatory character;

II - accept contract of those who already have a private detective formed, except:

a) with the prior authorization of the person with whom he or she will collaborate or who will be replaced;

b) in the event of a dissolution between the contractor and the professional precedent or omission of that contractor that may cause damage to the contractor;

III - to divulge the means and the results of the collection of data and information to which it has access in the exercise of the profession, except in self-defense;

IV - participate directly in police investigations;

V - use, in demand against the contractor, the data, documents and information collected in the performance of the contract.

Art. 11. It is the duties of the private detective:

I - preserve the secrecy of information sources;

II - respect the right to privacy, privacy, honor and image of people;

III - exercise the profession with zeal and probity;

IV - to defend, with exemption, the rights and the professional prerogatives, taking care of the own reputation and the one of the class;

V - ensure the preservation and protection of documents, objects, data or information entrusted to it by the client;

VI - to restore, to the client's satisfaction, the contract or the request, document or object entrusted to him;

VII - accountable to the client.

Art. 12. They are the rights of the private detective:

I - exercise the profession throughout the national territory in the defense of the rights or interests entrusted to it, in the form of this Law;

II - refuse service that it considers immoral, discriminatory or illicit;

III - waive the contracted service, if it causes risk to their physical or moral integrity;

IV - compensate the amount of the fees received or receive it proportionally, according to the period worked, as agreed;

V - (VETOED);

VI - complain, verbally or in writing, before any authority, against breach of precept of law, regulation or bylaws;

VII - be publicly discharged, when wrongfully offended in the exercise of the profession.

Art. 13. This Law shall enter into force on the date of its publication.
